Who's Responsible For Mowing The Alley?

We have had a lot of questions regarding who is responsible for mowing the alleys and keeping them junk free.  A section from our Code of Ordinances, which may be found at https://z2.franklinlegal.net/franklin/Z2Browser2.html?showset=leforsset , has been included below.

Sec. 7.03.004     General requirements

(a)     Vegetation. It shall be unlawful for a person in control of any lot, tract or parcel of land, occupied or unoccupied, within the city limits, to allow grass, weeds, or any plant that is not cultivated to grow in rank profusion:

(1)     Upon such premises;

(2)     Along the sidewalk or street adjacent to the premises between the property line and the curb, or if there is no curb, then within ten (10) feet outside the property line;

(3)     In an alley or easement adjacent to the premises measured to the centerline of such alley or easement.

(b)     Accumulations of weeds, rubbish, etc. It shall be unlawful for a person in control of the premises as described above to permit the accumulation of weeds, rubbish, or any other objectionable, unsightly or unsanitary matter of whatever nature on such premises.

(c)     Duty to cut and remove. It shall be the duty of a person in control of the premises as described above to remove or cause to be removed all such grass, weeds, rubbish, brush, rubble or any other objectionable, unsightly or unsanitary matter of whatever nature as often as may be necessary to comply with this article.

(d)     Obstructing or injuring street or alley. It shall be unlawful for any person to willfully obstruct or injure, or cause to be obstructed or injured, or to maintain an obstruction in any manner whatsoever upon any street or alley adjacent to any premises owned or controlled by the person within the corporate limits of the city.

(e)     Removal of tree trimmings, shrub cuttings, etc. Any person, firm or corporation engaged in the business of cutting or trimming trees or shrubs shall be responsible for the disposal of trees, tree and shrub cuttings and trimmings at the expense of such person, firm or corporation. It shall be unlawful for such person, firm, or corporation to leave any trees, tree or shrub cuttings or trimmings at any location or upon the lot where cut as trash.
